Update: Johnson and Johnson to Pay $417 Million in Talcum Powder Case
As we reported to you earlier this year, Johnson and Johnson and their Baby Powder (talcum powder) product were under fire for causing ovarian cancer in women. Since then the cases against the big pharma giant have accumulated and Monday a huge nail was driven into the companies coffin concerning their Baby Powder product. On Monday, a California woman was awarded $417 million because she developed ovarian cancer and had used Johnson & Johnson Baby Powder for decades. The award includes $70 million in compensatory damages and $347 million in punitive damages.
A 63-year-old Los Angeles resident, Eva Echeverria said she had been using the powder as a regular part of her feminine hygiene routine since she was 11 years old. Eva stopped using the product in 2016, after reading about another woman who had used the product and now had ovarian cancer. If you were to ask how many women have used Johnson & Johnson’s talcum powder (baby powder) it would be in the millions. The company’s “Shower to Shower” brand has for a long time been recommended by the company to be a part of women’s daily hygiene routine. Due to recent studies and court documents, Johnson & Johnson has been in possession of scientific studies and indicating women who regularly use these products for hygienic use have a greater rate of ovarian cancer.
Johnson & Johnson, of course, has denied any knowledge of this, but a jury recently found them responsible in an ovarian cancer wrongful death lawsuit and ordered to the company to award the suing family in Alabama $72 million dollars in damages. Johnson & Johnson was ordered by a U.S. jury in May of 2016 to pay $55 million to a woman who said that using the company’s talc-powder products for feminine hygiene caused her to develop ovarian cancer. Now with the huge decision coming out of California, the thousands of cases that have been filed against Johnson and Johnson across the nation have to be a huge concern to the company.
This is what Johnson and Johnson had to say to CNN about the California decision: “Ovarian cancer is a devastating diagnosis and we deeply sympathize with the women and families impacted by this disease,” Carol Goodrich, a representative for Johnson & Johnson Consumer Inc., said in a statement. “We will appeal today’s verdict because we are guided by the science, which supports the safety of Johnson’s Baby Powder. In April, the National Cancer Institute’s Physician Data Query Editorial Board wrote, ‘The weight of evidence does not support an association between perineal talc exposure and an increased risk of ovarian cancer.’ We are preparing for additional trials in the US and we will continue to defend the safety of Johnson’s Baby Powder.” Johnson & Johnson continued to state that it will begin the appeals process in the California case.
